01Who we are

Svear and Velo 31 are operated by Svear Marketing LLC, a Virginia limited liability company (“Svear Marketing LLC,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, share, and retain personal information when you use the Services described below.

02What this policy covers

This policy applies to the following, together called the “Services”:

  • the svear.io website, Svear, and Velo 31;
  • the Creative Pack;
  • our software;
  • our marketing, advertising, and agency services; and
  • related Services, including the Svear SMS program described below.

When a client uses the Services to handle information about its own leads and customers, the client is responsible for the privacy notices and consents it gives those people. We process that information to provide the Services to the client, as described in this policy and our Terms of Service.

03Information we collect

What we collect depends on how the Services are used. Not every category applies to every person. For example, a visitor who only browses svear.io shares the technical information described under “Information collected automatically” and nothing else.

Information you provide

  • name, email address, phone number, and business information;
  • form submissions, such as early-access requests, applications to work with us, the business intake, the client onboarding form, and the Creative Pack intake;
  • login and account information;
  • support communications and other messages you send us;
  • files, images, creative assets, and other materials you upload; and
  • prompts and other input you give AI-powered features, and the output they produce.

For example, an early-access request asks for your name, work email, and agency name, and can include how many client accounts you manage and what you would like to improve. The business intake asks about your business, your leads, your numbers, and your capacity, and records any referral or campaign tags in the link you followed to it. The client onboarding form asks about your business, branding, services, pricing, lead delivery and website, and keeps the logo, photos and documents you upload in private storage so we can set everything up.

Information clients provide about their leads and customers

  • lead and customer information that clients upload into or collect through Velo 31;
  • SMS and other message data, such as message content, delivery status, and opt-out replies; and
  • email event and engagement data, such as delivery, bounce, open, and click events.

Payment and transaction information

Payments are handled by third-party payment processors, including Square and Stripe, which collect and process payment card details under their own terms and privacy policies. We receive transaction information from them, such as what was purchased, the amount, the date, and the payment status, and may receive limited payment details such as the card type or the last four digits of the card.

Information collected automatically

  • usage and activity data, such as the pages you view and the features you use;
  • IP address;
  • device and browser information;
  • cookies and similar technologies; and
  • analytics, advertising, and tracking data, including Meta Pixel event data, as described under Cookies and tracking.

SMS messaging

If you opt in to receive text messages from Svear, we collect your mobile phone number, a record of your SMS opt-in and consent (such as when and how you opted in), and information about your messaging interactions, such as messages sent and received and any STOP or HELP replies.

04How we use information

Depending on the Services involved, we use information to:

  • provide, operate, and maintain the Services, including Velo 31;
  • handle leads and customer records, and run messaging workflows;
  • manage accounts, respond to requests, and provide support;
  • carry out marketing and advertising, including audience creation, campaign targeting, campaign measurement, retargeting, and campaign optimization, as described under Advertising and client lead data;
  • understand how the Services are used, through analytics;
  • bill for the Services and process payments;
  • protect the Services and their users, and prevent fraud;
  • provide AI-powered functionality;
  • improve the Services and develop new features;
  • send the text messages you opted in to receive, respond to HELP requests, honor STOP requests, and keep records of consent and opt-out choices; and
  • comply with legal obligations, enforce our terms, and resolve disputes.

05Advertising and client lead data

We may use certain information for marketing, advertising, campaign targeting, audience creation, retargeting, campaign measurement, optimization, and related advertising activities. This may include activity on our websites as well as customer or lead information provided to us by clients where the client has authorized such use and has the necessary rights, notices, permissions, and consents.

Clients are responsible for ensuring that customer and lead information they provide to Svear Marketing LLC may lawfully be used for the requested advertising and marketing purposes. We use customer or lead information that a client provides for advertising only as that client has authorized.

Advertising platforms such as Meta process the information they receive under their own terms and policies. These advertising uses never include sharing SMS opt-in consent data, as described under SMS / Mobile Messaging Privacy.

06Cookies and tracking

The Services use cookies, analytics, the Meta Pixel, and other advertising and campaign or event-tracking technologies. We use them for analytics, attribution, retargeting, advertising measurement, and campaign optimization. Campaigns we run or measure for clients may also use pixels and conversion or event tracking set up with the client's authorization.

The Meta Pixel on svear.io

The svear.io website uses the Meta Pixel (pixel ID 1020032127731612), an advertising and analytics tool provided by Meta. It loads on every page and records a page view when you open a page or move between pages. On the Creative Pack page it also records when you click a checkout button, before you are sent to our payment provider. On the business intake and client onboarding pages it is switched off before you can enter anything, so your answers there are not sent to Meta.

The Meta Pixel sets cookies and sends information to Meta, including your IP address, browser and device details, the page you are viewing, and the page you arrived from. If you are signed in to a Meta service, Meta may be able to associate this activity with your account. Meta's own handling of that information is described in Meta's privacy policy.

Your choices

You can limit tracking through your browser settings, a content or ad blocker, or your Meta ad preferences. The website works normally if the Meta Pixel is blocked.

The website also keeps a few preferences in your browser's own storage: whether you paused background motion, whether the opening animation has already played in this browsing session, and your unfinished business intake or client onboarding answers, so you can pick up where you left off. Those answers are cleared from your browser once you send them.

07AI-powered features

When you use AI-powered features, prompts, uploaded content, business data, creative inputs, and related information may be sent to and processed by AI and model providers, such as Anthropic, Google (through the Gemini API), Higgsfield, and other AI providers used by the Services, to produce the output you asked for. Those providers process information under their own terms and policies, which may allow them to retain it for a period of time. Please avoid including personal information in prompts or uploads that the feature does not need.

08Svear Lights visualizer

Svear Lights is a Christmas light visualizer that we provide to installation businesses, our clients, at their own link or on their websites. A homeowner uploads a photo of their home, designs a light display, and sends the design with their contact details to the installer.

We process and route those leads as part of providing the visualizer and its integrations to the installer. Depending on the installer's setup, this can include a shared lead-routing scenario that we run on Make, which delivers each lead to that installer. Each lead also carries a record of the consent wording the homeowner accepted and when they accepted it. No IP address is collected for this record.

If Realistic Preview is on for the installer (it's included and on unless they ask us to turn it off) and the homeowner uses it, a copy of the homeowner's house photo is sent to AI providers, currently Google (through the Gemini API) and Anthropic. Google receives the photo and a fixed instruction to create an evening version of it; that request uses a no-store setting. Anthropic receives the original photo and Google's evening version, to check the result. The homeowner's design, name, phone number, email address, service address, notes and budget are not sent to these providers, although anything visible in the photo itself, such as a house number, may be visible to them. The realistic image may be included with the design the homeowner sends and delivered to the installer. AI providers handle what they receive under their own terms and policies, which may allow them to retain it for a period of time.

Svear Lights customers can also read the Svear Lights privacy policy at lights.svear.io/privacy.

09SMS / Mobile Messaging Privacy

In short

  • We do not share, sell, rent, or provide mobile phone numbers or SMS opt-in consent data to third parties or affiliates for their own marketing or promotional purposes.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to opt out at any time. Reply HELP for help.

We collect mobile phone numbers and SMS consent information for the Svear SMS program only when you voluntarily opt in to receive text messages from Svear. We use that information to send the messages you asked for and to keep records of your consent and opt-out choices.

We do not share, sell, rent, or provide mobile phone numbers or SMS opt-in consent data to third parties or affiliates for their own marketing or promotional purposes. This commitment applies notwithstanding anything else in this policy. Service providers that deliver text messages on our behalf process phone numbers and message content only to deliver those messages and support the messaging program. They are not permitted to use numbers or consent information for their own marketing.

When a client uses Velo 31 to send text messages to its own leads or customers, those messages are sent on the client's behalf, and the client is responsible for obtaining any consent the law requires. We process that message data to deliver the messages and may apply safeguards such as opt-out handling.

Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for help. See the SMS Messaging Terms for the full program terms.

10Service providers and sharing

We share information with service providers that help us run the Services. Depending on the feature or service, these include:

  • Vercel, for website and application hosting;
  • Supabase, for application data and accounts;
  • Stripe and Square, for payments;
  • Resend, for email delivery;
  • Twilio, for text messaging;
  • Make, for routing Svear Lights leads to installers;
  • Meta, for advertising and measurement;
  • Anthropic, Google (through the Gemini API), Higgsfield, and other AI providers used by the Services, for AI-powered features, including Svear Lights' realistic previews; and
  • Airtable and Tally, for forms and records.

Which providers are involved depends on the feature or service you use, and not every provider receives every type of information. Providers may process information on behalf of Svear Marketing LLC or under their own terms and policies.

We may also disclose information when required by law or legal process, or when reasonably necessary to protect the rights, safety, or security of the Services, our clients, or others.

Nothing in this section permits sharing mobile phone numbers or SMS opt-in consent data with third parties or affiliates for their marketing or promotional purposes. That information is handled only as described under SMS / Mobile Messaging Privacy.

11Sale of personal information

Svear Marketing LLC does not sell personal information for monetary consideration.

12Retention

We generally retain personal information for up to two years after collection or the end of the relevant customer relationship, unless a longer or shorter period is necessary for legal, security, accounting, contractual, dispute-resolution, operational, or other legitimate purposes.

For example, we may keep a record of an SMS opt-out for as long as we need it to keep honoring that opt-out.

13Your privacy rights

You may ask us to access, correct, or delete your personal information by emailing svear.io@svear.io. We may need to verify your identity before we respond. If we process your information on behalf of a client business, we may need to work with that business to respond.

Some records may be kept after a deletion request where the law requires or permits it, including for legal obligations, security, fraud prevention, accounting, contractual obligations, and disputes.

You can stop receiving text messages from Svear at any time by replying STOP.

14Children

The Services are not intended for people under 18. Svear Marketing LLC does not knowingly collect personal information from children under 18 through its customer-facing Services.

15Where information is processed

Information may be stored, processed, and transferred outside your state or country through the infrastructure and service providers that run the Services.

16Security

We use reasonable administrative, technical, and organizational safeguards to protect the information we hold. No method of transmission or storage is completely secure, so we cannot guarantee the security of any information.

17Changes to this policy

We may update this policy from time to time. When we do, we will post the updated policy on this page with a new effective date.
